For the first time since its introduction, the Party Wall etc. Act 1996 has been updated to permit notices and documents to be served electronically via email.
This change, made under the Electronic Communications Act 2000, took effect on 6th April 2016 through the Party Wall etc. Act 1996 (Electronic Communications) Order 2016.
Implications of Email Service
Serving notices by email offers several advantages:
- Time savings – Faster delivery allows works to commence sooner where all parties agree.
- Cost reduction – Eliminates the need for printing and postage.
- Environmental benefits – Reduces paper usage, lowering the project’s carbon footprint.
Conditions for Valid Email Service
Email service is valid only if:
- The recipient has confirmed in writing their consent to receive notices electronically.
- The consent has not been withdrawn.
- The notice is sent to the specific email address provided by the recipient.
If a neighbour or surveyor does not wish to receive documents electronically, traditional paper service must still be used.
Why This Update Matters
The ability to serve notices electronically improves the efficiency and flexibility of the Party Wall process. It allows disputes to be addressed more promptly, enabling projects to proceed without unnecessary delay.
