If you’re reading this, it means you’ve received a Party Wall Notice. Hopefully, the accompanying letter and drawings help clarify the Party Wall process and the proposed construction works.
We’re going to quickly walk you through the different response options to ensure you fully understand them.
Response Option 1: Consent to the Party Wall Notice and Construction Works
By consenting, you’re agreeing that no surveying procedures will be necessary, and the building owner can begin construction without delay.
Response Option 2: Object to the Party Wall Notice and Appoint Your Own Party Wall Surveyor
If you object to the Party Wall Notice, you’ll need to appoint your own Party Wall Surveyor. This surveyor will act in your best interest, reviewing the construction works and ensuring any risks to your property are minimised. Your surveyor will also work with one of our surveyors to create a Party Wall Award, which legally governs the proposed works and offers legal protection throughout the process.
Response Option 3: Object to the Party Wall Notice and Appoint an Agreed Party Wall Surveyor
This option is similar to Option 2, but instead of appointing your own surveyor, you and the building owner will agree on a single surveyor from Simple Survey who will represent both parties. This joint surveyor will guide the process to create the Party Wall Award, ensuring everything is fair and impartial. People often ask how a single surveyor can remain impartial, and the answer is simple: a Party Wall Surveyor represents the property itself, not the owners, and makes decisions based on the nature of the property and the construction work.
Costs
No matter which option you choose, the building owner will be responsible for covering all costs, expenses, and fees related to the Party Wall surveying process.
We hope this article has helped you understand your options. Now, all you need to do is select the response!
