Building Work Covered by the Party Wall Act

The Party Wall etc. Act 1996 is a legal framework designed to prevent and resolve disputes between neighbours when building works could affect shared walls, boundaries, or nearby foundations. It applies across England and Wales and generally covers three categories of work:


1. Alterations to an Existing Party Wall or Party Structure

These are works that directly involve a shared wall, such as:

  • Cutting into the wall to insert beams (for example, during a loft conversion or extension).
  • Raising or underpinning the wall to support additional floors or structural stability.
  • Strengthening or thickening the wall for reinforcement or insulation.
  • Demolishing and rebuilding a party wall in poor condition.
  • Removing features such as chimney breasts that project into the wall.
  • Applying weatherproofing where a wall is exposed as a result of building work.

2. Building New Walls at or Near the Boundary

The Act also applies when:

  • Constructing a new wall directly on the boundary line between two properties.
  • Building a wall close to, but entirely within, your own land when it adjoins the boundary.

3. Excavation Works Close to a Neighbouring Property

Excavations may be covered if:

  • Digging within 3 metres of your neighbour’s building where the excavation is deeper than their foundations.
  • Digging within 6 metres where a 45-degree line from the base of your neighbour’s foundations would intersect the proposed excavation depth.

Key Points to Remember

  • Notice Requirement – The property owner must serve formal written notice on affected neighbours before carrying out works covered by the Act.
  • Consent or Dispute – If the neighbour (Adjoining Owner) does not agree, one or more Party Wall Surveyors may need to be appointed.
  • Party Wall Award – Where required, surveyors will draw up a legally binding Party Wall Award setting out the details of the work, protective measures, and access rights.
