What is a Party Wall Award?
A Party Wall Award is a legally binding document issued by one or more appointed Party Wall Surveyors under the Party Wall etc. Act 1996. It sets out how and when notifiable works may proceed and determines responsibility for surveyors’ fees.

Is a Party Wall Award the same as a Party Wall Agreement?
No. The Act only recognises Awards. Terms like “Party Wall Agreement” are commonly used but have no legal standing.

When is a Party Wall Award needed?
An Award is required whenever a dispute arises following a Party Wall Notice. It is the only formal method of resolution under the Act, unless both parties reach an agreement outside of it.

Who prepares a Party Wall Award?
Only an appointed Party Wall Surveyor can issue an Award. This may be:

  • A single Agreed Surveyor (appointed jointly by both owners), or
  • Two separate surveyors (one appointed by each party). A Third Surveyor may be called upon if disagreements persist.

Can I prepare my own Party Wall Award?
No. The Act does not allow property owners to act as their own surveyor.

Who pays for the Award?
In most cases, the Building Owner pays, since the works are for their benefit. Costs may be shared if the works are mutually beneficial.

Is a Party Wall Award legally binding?
Yes. Once issued, both parties are legally obliged to comply.

How long is a Party Wall Award valid for?
Works authorised by an Award must usually begin within 12 months. However, obligations such as making good damage remain enforceable beyond this period.

Can a Party Wall Award be appealed?
Yes. Either party may appeal to the County Court within 14 days of the Award being served.

Can I start work before the Award is served?
No. Works can only begin after the statutory notice period has expired and the Award has been issued, unless the Adjoining Owner provides written consent.

Can I carry out works while an Award is under appeal?
Yes — unless the court orders otherwise, the Award remains enforceable. However, for complex or sensitive projects, it may be prudent to wait until the appeal is resolved.

What if my design changes after the Award is issued?

  • Minor changes: the existing Award may still apply.
  • Significant changes: a further (Addendum) Award may be required.
