Party Wall Awards Don’t Need To Be Confusing

A Party Wall Award is a legally binding document made under the Party Wall etc. Act 1996. It is prepared by surveyors to resolve disputes between property owners when building works affect a shared wall, boundary, or nearby structure.

The Award sets out each owner’s rights and responsibilities, providing a clear framework for how works should proceed. Typical inclusions are:

  • A description of the works and how they will be carried out
  • Access arrangements for contractors or surveyors
  • Protective measures to safeguard adjoining property
  • Procedures for dealing with damage or compensation

By formalising the process, a Party Wall Award ensures works can continue lawfully while protecting both the Building Owner and the Adjoining Owner.


Retrospective Agreements

In some cases, work may start (or even be completed) without serving the correct notice under the Act. A retrospective party wall agreement can sometimes be put in place afterwards.

This involves serving notices late, appointing surveyors if required, and recording the agreed terms relating to the works already carried out. While possible, retrospective agreements can be more complicated, create mistrust, and lead to disputes or additional costs.

For larger or more complex works (such as basements, underpinning, or where disputes arise), fees can rise into the thousands. Typically, the Building Owner pays the reasonable fees of all appointed surveyors.
