Can Anyone Act as a Party Wall Surveyor?

Short answer: yes—provided they are not a party to the matter (i.e., not the Building Owner or the Adjoining Owner).
The Act defines a surveyor as “any person not being a party to the matter” appointed under Section 10 to determine disputes. In practice, that means a wide spectrum of professionals can act—but choosing wisely matters.

What to look for in a Party Wall Surveyor

1) Relevant qualifications
Seek professionals with grounding in construction and building pathology—commonly building surveyors, architects, or structural engineers—who understand methods, risks, and temporary works.

2) Practical experience
Party wall work is procedural and technical. Prefer surveyors with a track record issuing Awards, running schedules of condition, and resolving damage/fee disputes efficiently.

3) Mastery of the legislation
Your surveyor should be fluent in the Party Wall etc. Act 1996—notice requirements, Section 2 and 6 triggers, Section 8 access, Section 10 dispute resolution, and the case law that shapes best practice.

4) Independence and impartiality
Impartiality is not optional. Avoid conflicts (e.g., a designer whose fee depends on a particular outcome). A good surveyor can robustly test both sides’ positions and land a fair Award.

5) Professional memberships
Memberships can signal standards and CPD: e.g., RICS, CIOB, or other recognised bodies. These often come with codes of conduct and complaints procedures.

6) Professional indemnity insurance
Ask for PII confirmation. Reputable surveyors maintain cover proportionate to the project risk.

7) Clear fees and communication
Look for transparent fee terms and plain-English updates that keep programmes moving.
