Do You Really Need a Party Wall Surveyor? Here’s Why the Answer is Likely “Yes”

You might have heard the term Party Wall Surveyor in passing, but knowing whether you actually need one is another matter entirely. If your building project involves work near or on a shared structure, getting a surveyor involved isn’t just a good idea — it’s often essential.


First Things First — What Exactly Is a Party Wall?

A party wall is any wall, floor, or structure that either:

  • Sits on the boundary between your property and your neighbour’s
  • Forms part of your neighbour’s building but is shared by you both

That includes obvious features, like the wall between two terraced houses, but also less obvious cases — for example, apartment floors and ceilings.

If your works will cut into, build on, or dig near one of these structures, the Party Wall etc. Act 1996 likely applies. When in doubt, a Party Wall Surveyor can tell you for certain.


What Does a Party Wall Surveyor Actually Do?

Their role can be split into two main parts:

1. Representing the Building Owner
They can prepare and serve the Party Wall Notice on your behalf, ensuring it’s valid and includes everything needed.

2. Mediating Disputes Under the Act
If your neighbour objects to the works, the surveyor acts impartially to resolve matters. They will:

  • Draft and serve a legally binding Party Wall Award setting out how and when works will take place, and how any damage will be dealt with
  • Ensure both sides’ rights are protected under the Act

If either party disagrees with the Award, they have 14 days to appeal to the County Court.
