What Is a Party Wall Notice?

A Party Wall Notice is a formal written notification served to adjoining owners when planned work affects a party wall, boundary, or shared structure. It is the first legal step under the Party Wall etc. Act 1996.

When Must You Serve a Notice? Notice must be served before starting work that:

  • Builds a new wall on the boundary
  • Repairs or alters an existing party wall
  • Excavates near a neighbour’s foundations within certain limits

What Should the Notice Include? The notice must clearly state:

  • The nature and extent of the proposed work
  • The intended start date and duration of the project
  • How the work might affect the party wall or neighbour’s property

How to Serve the Notice

You can deliver the notice by hand, post (preferably recorded delivery), or email if agreed by the neighbour. It’s essential to keep proof of delivery.

Neighbours’ Response Adjoining owners have 14 days to respond by:

  • Consenting to the work
  • Dissenting and requesting a party wall surveyor
  • Not responding, which legally counts as dissent
