1. Section 1 Notice – Line of Junction Notice
Required when:
- You plan to build a new wall up to or along the boundary line.
- You propose to build a wall astride the boundary (a party fence wall), subject to neighbour’s consent.
📌 Notice period: At least 1 month before works begin.
⚠️ If the new wall’s foundations are deeper than your neighbour’s, a Section 6 Notice may also be required.
2. Section 3 Notice – Party Structure Notice
Required when you intend to carry out works directly affecting an existing party wall or structure. Examples include:
- Cutting into a wall to insert beams, flashings, or a damp proof course.
- Removing chimney breasts or other projections.
- Raising, rebuilding, repairing, or underpinning a party wall.
- Enclosing upon a wall at the boundary and turning it into a party wall.
📌 Notice period: At least 2 months before works begin.
3. Section 6 Notice – Notice of Adjacent Excavation
Required when excavating near your neighbour’s property. This applies if you are:
- Excavating within 3 metres of their foundations to a lower depth, or
- Excavating within 6 metres, where the works will go below a line drawn at 45° from the bottom of their foundations.
📌 Notice period: At least 1 month before works begin.
📎 Plans and cross-sections of the proposed works must be included with the notice.
