Building Owner’s Party Wall Surveyor Guidance

At Simple Survey, we guide Building Owners through every stage of the Party Wall process. Whether you’re extending your home, constructing close to a boundary, or making alterations to a shared wall, our fixed-fee service provides clarity, legal compliance, and reassurance under the Party Wall etc. Act 1996.

What Our Service Includes

For one clear, fixed fee, our Building Owner Surveyor package covers:

  • Land Registry searches to confirm adjoining ownership details
  • Drafting and serving bespoke Party Wall Notices
  • Drafting and serving of the legally binding Party Wall Award

We work with clients across England & Wales—covering residential homes, offices, and commercial premises. Whether appointed solely on your behalf or as an Agreed Surveyor for both parties, we deliver a cost-effective, professional service that safeguards all owners involved.

When the Act Applies

You’ll need to follow the Party Wall Act if you plan works such as:

  • Altering a party wall (e.g., cutting in beams or removing chimneys)
  • Building a new wall on or near a boundary line
  • Excavating close to neighbouring foundations (e.g., for extensions or basements)

⚠️ Excavations are often overlooked but are one of the most common reasons the Act applies.

Notice and Award Process

If your works are covered by the Act, you must serve a Party Wall Notice on all affected neighbours.

  • If they consent: Works can usually proceed.
  • If they dissent (or do not reply): Surveyors are appointed, and a Party Wall Award is agreed, setting out how the works should progress while protecting both parties.

💡 Tip: Speaking to your neighbour informally before serving notice often makes the process smoother.

Common Questions

Who is classed as a Building Owner?
Anyone planning works covered by the Act—usually a freeholder or a leaseholder with more than 12 months left on their lease.

When must I serve a Party Wall Notice?
Before altering a party wall, building near a boundary, or excavating close to neighbouring foundations.

Who pays the surveyor’s fees?
In most cases, the Building Owner covers the reasonable costs of all surveyors involved.

What’s included in a Party Wall Award?
An Award sets out how and when works will take place, including working hours, construction methods, and protections. It also incorporates the Schedule of Condition, which safeguards both owners if damage occurs.
