Understanding a Party Wall

A Party Wall is a structure located on the boundary between two or more properties. Specifically:

  • A wall forming part of a building shared between properties is a Party Wall.
  • A garden wall dividing land between properties is a Party Fence Wall.
  • Floors and other dividing structures may also be considered under the provisions of the Act.

When the Party Wall Act Applies

The Act governs a wide range of building works, including:

  • Alterations to an existing party wall, party fence wall, or party structure
  • Construction of new walls on or along a boundary line
  • Excavations within 3 to 6 metres of a neighbouring foundation, depending on the depth

Obligations if Your Works Are Covered

If your proposed works fall within the scope of the Act, you are legally required to serve a Party Wall Notice on your neighbour. The notice must include:

  • A description of the proposed works
  • Relevant plans and drawings, where applicable
  • The proposed start date of works
  • For excavations, details of the foundations

Responding to a Neighbour’s Objection

Even if a neighbour objects, works permitted under the Act may proceed. However, objections trigger the dispute resolution procedure under Section 10 of the Act:

  • You must appoint a Party Wall Surveyor.
  • Your neighbour may appoint their own surveyor, or both parties may agree to a single Agreed Surveyor.
  • If two surveyors are appointed, they will jointly select a Third Surveyor to resolve any disagreements.

The Party Wall Agreement

The formal legal term is a Party Wall Award. This document, prepared by the surveyor(s),:

  • Defines the rights and obligations of each property owner
  • Specifies how and when the works may proceed
  • Records the condition of the adjoining property prior to commencement

A Party Wall Award provides protection for all parties and ensures that the project proceeds in compliance with the law.
