What Is the Party Wall Act?

The Party Wall etc. Act 1996 is designed to avoid disputes between neighbours when building works affect shared walls or nearby structures. It applies to:

  • Shared walls between properties (party walls)
  • Floors between flats or maisonettes
  • Garden boundary walls or outbuildings near a neighbour’s property

Does It Apply to Loft Conversions?

In most cases — yes. You’ll need to follow the Party Wall process if your loft project involves:

  • Cutting into a shared (party) wall to insert steel beams
  • Raising or altering the party wall
  • Excavating within 3 metres of a neighbour’s foundations (e.g. for new footings or support structures)

If your work falls into these categories, you’ll need to serve a Party Wall Notice to your neighbours.


What Is a Party Wall Notice?

It’s a formal written notice informing your neighbour that works covered by the Act are planned. You must give at least two months’ notice before construction starts.

Your neighbour then has 14 days to respond. If they consent, you’re good to go.
If they dissent or don’t reply at all, you’ll need to appoint a Party Wall Surveyor to draw up a legally binding Party Wall Award.


Do I Always Need a Surveyor?

Not necessarily. If your neighbour agrees to the work in writing, you may not need a formal agreement or surveyor.

However, if there’s any hesitation, disagreement, or risk of future conflict, hiring a qualified Party Wall Surveyor protects both you and your neighbour — and keeps your project compliant with the law.
