Received a Party Wall Notice – What Are Your Options?

Once served, you have 14 days to respond. Here are your three main options:


Consent to the Works

You can choose to give your consent. But beware – by doing this, you’ll also take on liability for any damage to your property.


🔍 Dissent – Use the Same Surveyor

You may refuse consent but agree to use your neighbour’s Party Wall Surveyor.
This independent expert will record the condition of both properties and resolve any disputes. Your neighbour covers the cost.


🧱 Dissent – Appoint Your Own Surveyor

Prefer to have your own representation? You and your neighbour each appoint a separate surveyor.
Both will inspect the properties and agree on a Party Wall Award. Again, your neighbour pays both fees.


What If You Don’t Respond?

If you ignore the Notice for 14 days, you can no longer give consent. Instead, you’ll get a 10-day follow-up notice asking you to appoint a surveyor.

Fail to reply again? Your neighbour’s surveyor will legally appoint a third, impartial surveyor on your behalf under section 10(4) of the Act. The project can then proceed.
