The Party Wall etc Act 1996, September’s Top FAQs

The Party Wall Act can seem complex, but with the right advice and surveyor, the process is straightforward. Whether you’re a building owner planning works, or a neighbour protecting your property, compliance with the Act safeguards everyone involved.

We look at this month’s most asked questions;

1. What is the Party Wall Act?

The Party Wall etc. Act 1996 is UK legislation that regulates building work on or near shared walls, boundaries, or adjoining structures. Its purpose is to protect both property owners and neighbours by ensuring works are carried out responsibly, with proper notice, and without causing damage to neighbouring properties.

2. When must I serve a Party Wall Notice?

A Party Wall Notice should be served before any work begins, including extensions, loft conversions, structural alterations, or excavation within 3–6 metres of a neighbouring property. Typically, you must give:

  • Two months’ notice for works to a party wall.
  • One month’s notice for excavation or boundary works.

3. Do I need a Party Wall Surveyor?

If your project could affect a party wall, boundary, or neighbouring structure, you must serve a formal Party Wall Notice. While homeowners can issue this themselves, using a qualified Party Wall Surveyor is strongly recommended. A surveyor ensures the notice is served correctly, manages any disputes, and issues legally binding agreements when needed.

4. What if my neighbour objects?

If your neighbour does not consent within 14 days, or formally objects, the Act requires surveyors to get involved. Either each party appoints their own surveyor, or both agree on one impartial surveyor. They will prepare a Party Wall Award setting out the terms of the work, timelines, and protections for both sides.

5. What is a Party Wall Award?

A Party Wall Award is a legally binding document issued by the appointed surveyor(s). It details how the work must be carried out, any conditions to protect neighbouring property, how damage will be handled, and who pays for what.

6. How much do Party Wall services cost?

Costs vary depending on the complexity of the work and whether disputes arise. We offer transparent fees and free initial consultations so you can plan with confidence.

7. How long does the process take?

The statutory notice period is up to two months, with an additional month for excavation work. If neighbours consent, the process is relatively quick. If surveyors are needed, allow extra time—most awards are completed within 2–3 months, though complex disputes can take longer.

8. Can I start work before an Award is issued?

No. You must wait until the process is complete and, where required, a Party Wall Award is in place. Beginning work early risks injunctions, delays, and legal disputes.

9. Do internal works require notice?

If works are purely internal and do not affect a shared wall or structure, no notice is required. However, if they involve structural changes to the party wall (e.g., inserting beams for a loft conversion), a notice is compulsory.

10. What if the neighbouring property is vacant?

If the adjoining property is unoccupied or has no registered owner, you may not need to serve notice—but this depends on the circumstances. A Party Wall Surveyor can confirm whether notice is required.

11. How do I know if my project needs a Party Wall Notice?

Any construction, alteration, or excavation near a shared wall or boundary may fall under the Act. If you’re unsure, get professional advice. We offer free consultations to confirm whether your project requires notices or agreements.

12. Can my neighbour and I share one surveyor?

Yes. Both parties can agree to appoint a single surveyor, known as the Agreed Surveyor. This can save time and money, but both sides must be comfortable with the arrangement.

13. What if my neighbour refuses to cooperate?

If your neighbour refuses to sign or ignores the notice, the law assumes dissent. In this case, surveyors will step in to resolve matters and issue a Party Wall Award, allowing works to proceed legally.
