Do I need a Party Wall Award?

A Party Wall Award isn’t always mandatory, but it provides valuable protection for both Building Owners and Adjoining Owners.

For the Building Owner:

  • Confirms that any damage to the neighbour’s property is linked to the building works
  • Grants a legal right of access to the adjoining land (if required for the works)
  • Protects against false or exaggerated damage claims

For the Adjoining Owner (Neighbour):

  • Specifies working hours to minimise disruption
  • Ensures that any damage is repaired at no cost to them
  • Requires contractors to carry valid public liability insurance

👉 In short: while smaller works (like repointing or minor damp proofing) may not justify the cost of a Party Wall Award, in most cases it offers peace of mind and formal protection for both sides.


I’ve received a Party Wall Notice – can I just consent?

Yes, you can reply with written consent and allow the Building Owner to proceed.
However, we strongly recommend speaking with a Party Wall Surveyor first. This ensures that:

  • The notice is valid and legally compliant
  • The correct details and documents are included
  • Your property interests are fully protected

What if I don’t agree with the Party Wall Notice?

If you do not consent within 14 days of receiving the notice, the law automatically considers this a dispute.

This means:

  • A Party Wall Award will need to be prepared by a qualified surveyor
  • Both parties either appoint their own surveyors or agree to use a single impartial surveyor
  • If the Adjoining Owner does not appoint a surveyor within the timeframe, the Building Owner may appoint one on their behalf (this does not mean it is an “agreed” surveyor, but a separate independent professional)

Importantly, once a dispute is triggered, surveyors are no longer acting for their client – instead, they become impartial experts acting under the Party Wall Act.
