If you’re planning construction work close to a neighbouring property, or on a shared wall, you may need the help of a Party Wall Surveyor. The Party Wall etc. Act 1996 sets out the legal process for preventing and resolving disputes involving:
- Shared (party) walls
- Boundary walls
- Excavations near neighbouring buildings
The Act requires building owners to follow specific procedures before starting any work that could impact an adjoining property. By following these steps, disputes can be avoided, delays minimised, and projects can move forward smoothly.
Common Projects That Require a Party Wall Notice
Loft Conversions
Loft conversions in terraced or semi-detached homes often involve inserting beams into a party wall. This usually requires serving a Party Structure Notice under Section 3 of the Act.
Chimney Breast Removal
Where a chimney breast is attached to a party wall, its removal is also covered by the Act. A Party Structure Notice will again need to be served.
Home Extensions
Building an extension can trigger two types of notices:
- Excavations within 3 metres of a neighbouring property with shallower foundations (Section 6)
- New walls built on or up to the boundary line (Section 1)
Basement Conversions
Basement projects often involve underpinning party walls and excavation close to neighbouring foundations. These works typically require notices under Sections 1, 3, and 6 of the Act.
The Party Wall Process in Wimbledon
When works fall under the Act, the Building Owner must:
- Serve formal notice on all affected neighbours (the Adjoining Owners)
- Obtain written consent before starting work
If neighbours do not consent, a dispute is deemed to have arisen. In this case, both parties must appoint surveyors (or agree on one impartial surveyor) to resolve the matter through a legally binding Party Wall Award.
When to Begin the Party Wall Process
It’s best to start the Party Wall process as early as possible. Appointing a surveyor at the design stage can help avoid costly delays, disputes, and even court proceedings. Party Wall procedures are detailed and technical, so professional guidance is highly recommended.
