Building work often affects neighbouring properties, especially when it involves a shared or boundary wall. In many cases, the Party Wall etc. Act 1996 applies. If it does, you may need to serve notice and appoint a Party Wall Surveyor.

What Is a Party Wall?
A party wall is any wall or structure on or near the boundary between two properties that benefits both owners. Examples include:

  • The dividing wall between terraced or semi-detached houses
  • A wall separating two gardens (if constructed from brick or stone)
  • A wall on one owner’s land but used by the neighbouring property

The Act ensures that building works affecting such walls are carried out safely and fairly.

When Does the Party Wall Act Apply?
The Act applies if you plan to:

  • Build a new wall on or at the boundary with your neighbour
  • Alter, cut into, or demolish part of a party wall or structure
  • Excavate within 3 or 6 metres of a neighbouring building (depending on depth)

If your works fall under the Act, you must serve formal written notice to your neighbours, typically at least two months before work begins.

Why Appoint a Party Wall Surveyor?
If your neighbour consents in writing, a surveyor may not be required. However, if they dissent—or fail to respond within 14 days—a dispute is deemed to have arisen.

A Party Wall Surveyor is then appointed to:

  • Act impartially for both parties
  • Review the proposed works and their potential impact
  • Prepare a legally binding Party Wall Award, setting out how and when the works may proceed

Sometimes, a single Agreed Surveyor acts for both parties; in other cases, each party appoints their own surveyor.

What Does a Party Wall Award Do?
The Award safeguards both owners by:

  • Confirming the Building Owner’s right to carry out the works
  • Establishing measures to protect the Adjoining Owner’s property
  • Providing a framework for handling damage or access issues
  • Ensuring the process is fair, impartial, and legally binding
