If you’re planning building works that affect a shared wall, boundary, or involve excavations near a neighbour’s property, you may need a Party Wall Agreement (legally known as a Party Wall Award). This guide explains when you need one, how the process works, and how Simple Survey can help.
What Is a Party Wall Agreement?
A Party Wall Agreement is a legally binding document that sets out the rights and responsibilities of both the Building Owner (carrying out the works) and the Adjoining Owner (the neighbour). It follows the service of a Party Wall Notice and typically includes:
- How and when the works will be carried out
- Protective measures for the neighbour’s property
- Access arrangements for contractors or surveyors
This ensures that both owners are protected and that any disputes are managed under the framework of the Party Wall etc. Act 1996.
When Do You Need a Party Wall Agreement?
You will usually need a Party Wall Agreement if your works involve:
- Building on or near the boundary line between two properties
- Altering or cutting into an existing party wall or structure
- Excavating foundations within 3–6 metres of a neighbour’s building
Common examples include:
- Extensions and loft conversions
- Removing chimney breasts
- Digging new foundations
- Underpinning or structural alterations
Minor works such as plastering, rewiring, or fitting shelves do not require a Party Wall Agreement.
Serving a Party Wall Notice
Before work starts, the Building Owner must serve a Party Wall Notice on all affected neighbours. Notice periods are:
- 2 months for works to a party wall or structure
- 1 month for excavations or new boundary walls
Neighbours then have 14 days to respond. If they:
- Consent → Works can proceed.
- Dissent (or do not reply) → A dispute is deemed to have arisen, and surveyors must be appointed to prepare a Party Wall Award.
Who Pays the Costs?
The Building Owner is usually responsible for surveyors’ fees and for any costs associated with producing the Award. Fees vary depending on the complexity of the works, but at Simple Survey our prices are fixed and transparent:
