When planning construction near a shared boundary, a Party Wall Notice must be served on the adjoining owner. This is necessary if you intend to build a new structure on or near the boundary, carry out repairs to a party wall, or excavate within 3 metres of your neighbour’s property.
The adjoining owner has three possible responses:
- Consent – allowing the work to proceed without further procedures.
- Appoint an Agreed Surveyor if they disagree.
- Disagree and appoint their own surveyor.
If the latter two options are chosen, the surveyor(s) will inspect the neighbouring property and prepare a Schedule of Condition. Following this, they will produce a Party Wall Award to formalise the process and ensure everything is legally compliant.
What Does a Party Wall Award Include?
A Party Wall Award is a detailed, legally binding document that covers several key aspects, including:
- A clear description of the scope of work: Detailed information about what will be done.
- Procedures to follow if damage occurs: Guidelines for addressing potential damage.
- Permitted construction hours: Defines acceptable working hours to minimise disruption.
- Access arrangements: Outlines when and how access to the adjoining property can occur.
- Construction methods to reduce damage risk: Instructions on how to minimise impact on the neighbouring property.
- Details of the surveyor(s) involved: Information about who is overseeing the process.
- Protocols for any changes to the proposals: How alterations to the work will be managed.
Benefits of a Party Wall Award
- For the Adjoining Owner:
The Award provides legal protection from damage caused by the building works. - For the Building Owner:
The Award protects the building owner from being held responsible for pre-existing damage. Importantly, it grants legal access to the neighbour’s property or roof space, which would otherwise require their permission.
In Summary: Why You Need a Party Wall Award
A Party Wall Award is crucial in protecting the interests of both parties and preventing disputes during construction near shared boundaries. It ensures clarity and fairness in managing potential risks and legal obligations.
